1. Acceptance of Terms
These Zen Cube Terms of Service (the "Terms") govern access to and use of the Zen Cube mobile application, the Zen Cube portable multi-sensory meditation device, related software, content, features, updates, and any related pilot services provided by Zen Cube Wellness Technologies, Inc. ("Zen Cube," "Company," "we," "us," or "our").
By accessing or using Zen Cube, including the device, mobile application, Sanctuary Experience, or any pilot version of the product, you agree to these Terms. If you use Zen Cube on behalf of a school, organization, family, or another user, you represent that you have authority to do so and that the relevant user or organization agrees to these Terms.
These Terms apply to the current pilot version of Zen Cube. They should be reviewed together with the Zen Cube Privacy Policy and any written pilot agreement, consent form, school agreement, or other written document that applies to your participation.
2. About Zen Cube
Zen Cube is a wellness technology product designed to support calm, mindfulness, relaxation, and everyday emotional well-being through a portable Sanctuary Experience. Zen Cube combines a physical device, a mobile application, onboard content, optional sensory features, and selected third-party services to provide structured calming experiences.
The Sanctuary Experience is the core product experience of Zen Cube. It may include soothing audio, ambient lighting, optional aromatherapy, projector-based visuals, and gentle interactive elements that together create a peaceful personal sanctuary.
Zen Cube is designed for general wellness and mindfulness support. It is not a medical product and is not intended to diagnose, treat, cure, or prevent any disease, disorder, condition, or mental health concern.
3. Product Components
For purposes of these Terms, "Zen Cube" includes the following components, as applicable to the current pilot version:
The physical Zen Cube device, a portable multi-sensory meditation device that can deliver guided calming plans through onboard hardware and software systems.
The Zen Cube mobile application, which serves as the primary user interface for device setup, session selection, mode selection, and sensory preference selection.
The Sanctuary Experience, which may include guided breathing, grounding, body scan, awareness practices, soothing audio, ambient lighting, optional aromatherapy, projection-based visuals, and gentle interactive elements.
Related software, firmware, pre-recorded calming plans, support materials, product updates, diagnostic tools, and pilot testing materials.
4. Pilot Status
Zen Cube is currently in a pilot stage. The product is still being tested, refined, and improved. Features may be incomplete, unavailable, delayed, modified, or removed during the pilot period.
The pilot is intended to help Zen Cube understand product usability, device performance, user experience, safety considerations, accessibility, and overall product quality. Pilot feedback may be used to improve the product, content, design, hardware, software, and support materials.
Zen Cube may pause, limit, update, or end the pilot at any time. Zen Cube does not guarantee uninterrupted operation, continuous availability, or permanent access to any pilot feature.
5. Who May Use Zen Cube
Zen Cube may be used by adults, families, schools, and supervised children in approved pilot settings. Users must use Zen Cube only as permitted by these Terms, the Privacy Policy, any applicable pilot materials, and any instructions provided by Zen Cube.
If you are using Zen Cube on behalf of a child, student, school, family, or organization, you are responsible for obtaining and maintaining any permission, consent, internal approval, supervision, and oversight required for that use.
Zen Cube may not be used by anyone who has been suspended from using the product or who is legally prohibited from using the product.
6. Use by Minors
Zen Cube is designed for both adults and minors in appropriately supervised settings.The current pilot version is designed with both Adults Mode and Kids Mode. Minors may use Zen Cube in family settings, school settings, or other supervised settings where appropriate adult oversight is provided. Kids Mode uses simpler, child-friendly language and pre-recorded calming plans. The purpose of Kids Mode is to make the experience easier for children to understand and follow.
Children should use Zen Cube only with appropriate adult supervision. Parents, guardians, educators, and pilot site personnel are responsible for deciding whether Zen Cube is appropriate for a particular child and for supervising the child’s use of the device and application.
School and family pilot participants should not enter a child’s full name, email address, student identification number, health information, disability information, diagnosis, Individualized Education Program (IEP) information, education record information, or other sensitive personal information into Zen Cube.
7. Wellness Use Only
Zen Cube is intended for general wellness, mindfulness, relaxation, and everyday emotional well-being support. Zen Cube does not provide medical care, mental health care, clinical care, therapy, counseling, diagnosis, treatment, crisis intervention, or emergency services.
Zen Cube content, voice interaction, Artificial Intelligence (AI) features, calming plans, sensory features, and product suggestions are not a substitute for professional medical advice, mental health advice, therapy, counseling, evaluation, or treatment from a qualified professional.
If you or another person may be experiencing a medical emergency, mental health emergency, risk of self-harm, risk of harm to others, or any urgent crisis, do not rely on Zen Cube. Zen Cube is not a crisis support service and is not designed to respond to emergencies, self-harm, suicidal thoughts, harmful behavior, or threats of harm to others. If you or someone else may be in danger, please contact a trusted person, family member, mental health professional, or local emergency services right now.
8. How Zen Cube Functions
The current pilot version supports structured meditation and calming sessions, including guided breathing, grounding, body scan, and awareness practices.
For school pilot settings, Zen Cube will be operated through the Zen Cube mobile application and the Zen Cube device. Users or authorized supervising adults may use the mobile application to select Adults Mode or Kids Mode, an emotional state, a calming plan, and sensory experience preferences. These selections are transmitted to the Cube through encrypted Bluetooth Low Energy (BLE), and the Cube then delivers the selected Sanctuary Experience through its onboard hardware and software systems.
Voice interaction will not be enabled for school pilot use. In school pilot settings, users will not launch a Sanctuary Experience through direct device-based voice interaction, and voice or Artificial Intelligence (AI) processing through a third-party cloud voice provider will not be used.
For family pilot testing, Zen Cube may support direct device-based voice interaction for a more natural, hands-free Sanctuary Experience. Family pilot users may launch a Sanctuary Experience either through the Zen Cube mobile application or directly through the device using built-in voice interaction.
The Cube may use soothing audio, ambient lighting, optional aromatherapy, projection-based visuals, and gentle interactive elements to support the selected Sanctuary Experience. Actual features may vary by pilot version, device configuration, pilot setting, software version, and available connectivity.
9. Voice Interaction and Artificial Intelligence
Voice interaction and Artificial Intelligence (AI) processing are not enabled for school pilot use. School pilot use is limited to app-based session selection and device delivery through the Zen Cube mobile application and Cube.
For family pilot testing, when voice interaction is enabled, voice and AI processing may occur directly between the Cube and the selected third-party cloud voice provider through the Cube’s Wi-Fi connection. The current pilot version is not designed as a fully offline AI system when voice interaction is enabled. The mobile application is not involved in the voice or AI processing path and does not transmit personal device data to Zen Cube servers.
Voice interaction and AI features may misunderstand speech, context, user intent, or a user’s situation. Any response generated through voice or AI features is for general wellness support only and should not be treated as professional advice, medical advice, crisis support, or a safety assessment.
Zen Cube does not store audio recording input from the user or voice output from the Interactive Voice Response (IVR) system in the current pilot version. Voice processing may involve a selected third-party cloud voice provider during family pilot testing where voice interaction is enabled. Use of such third-party services may be subject to the provider’s own terms and policies.
10. Mobile Application Interface and Permissions
The current pilot version includes a mobile application that serves as the primary user interface for setup and session selection. Through the application, users can select the relevant mode, emotion, calming plan, and sensory experience preferences.
The application communicates with the Cube through encrypted Bluetooth Low Energy (BLE). The application requests Bluetooth Always permission because it is required to communicate with the Cube.
The mobile application does not request microphone, camera, location, or notification permissions. The mobile application does not use advertising identifiers or marketing and attribution Software Development Kits (SDKs).
11. Data Handling in the Pilot
Zen Cube’s data handling for the pilot is described in more detail in the Zen Cube Privacy Policy. The following summary is provided to help users understand how the current pilot version functions.
For the mobile application used in the pilot, user-entered inputs may include emotion selection, Adults Mode or Kids Mode, calming plan, sensory experience preferences, a friendly device name, and, during setup, the user’s Wi-Fi Service Set Identifier (SSID) and Wi-Fi passphrase. These inputs are kept on the phone and sent only to the Cube through encrypted Bluetooth Low Energy (BLE). The Wi-Fi passphrase passes through the application to the Cube once during setup and is not retained on the phone afterward.
Stored locally on the phone are an onboarded flag and the paired Cube’s Bluetooth Low Energy (BLE) identifier, which is an opaque Universally Unique Identifier (UUID), not a hardware Media Access Control (MAC) address, stored in iOS Keychain. In-application state, such as current mode, temporary session selections, and last-completed timestamp, lives in memory.
The mobile application does not store Personally Identifiable Information (PII), location, contacts, or health data. The mobile application does not have a Zen Cube backend. Nothing is sent from the application to a Sanctuary Computer or Zen Cube cloud or backend. The phone does not proxy device data to Zen Cube servers.
From the device side, the Cube may store operational device-state information, logging, and telemetry data needed for product operation and troubleshooting. This may include Kids Mode versus Adults Mode, whether a request was processed successfully, request failure, connection status, and device responding status. The device also stores Wi-Fi credentials and pre-recorded calming plans needed for operation.
For school pilot settings, voice interaction is not enabled, and school pilot use is limited to app-based selections and device delivery. For family pilot testing, where voice interaction is enabled, Zen Cube does not store audio recording input from the user or voice output from the Interactive Voice Response (IVR) system in the current pilot version.
12. Third-Party Services Used by the Pilot
The mobile application may contact selected third-party services that support product operation, maintenance, and updates.
Sentry is used for production error tracking only. Sentry may receive crash and exception data, such as JavaScript stack trace, operating system version, application build number, and a short action label for triage context. For device-reported error states, Sentry may receive an error code, the Cube’s factory-assigned opaque device identifier, firmware version, calming-plan category, and session elapsed and total duration in seconds. This is operational diagnostic data used by engineering to identify recurring device issues. No user identifiers, name, email, account information, Wi-Fi credentials, Wi-Fi network names, emotion or experience selections, or user-entered text are attached to any Sentry event.
Expo Updates is used for standard over-the-air JavaScript bundle delivery when the application launches or when a new application version is released. No user data is included in the request.
The application does not use analytics Software Development Kits (SDKs) outside of Sentry, such as Mixpanel, Amplitude, or Segment. The application does not use advertising identifiers or marketing and attribution Software Development Kits (SDKs).
The Cube may communicate with a selected third-party cloud voice provider for voice and Artificial Intelligence (AI) processing only in family pilot testing when voice interaction is enabled. Voice interaction and cloud-based voice or AI processing are not used in school pilot settings. The availability, performance, and handling of data by third-party services may be subject to their own terms, policies, security practices, and technical limitations.
13. User Responsibilities
You agree to use Zen Cube in a safe, lawful, respectful, and appropriate manner. You are responsible for your own use of Zen Cube and for any use by children, students, family members, or other individuals under your supervision.
You agree not to enter or submit sensitive personal information into Zen Cube, including full names, email addresses, student identification numbers, health information, disability information, diagnosis information, education records, financial information, government identification numbers, passwords, or other sensitive information.
You are responsible for maintaining the security of your device, phone, Wi-Fi network, and any connected equipment. You are also responsible for following all setup instructions, safety instructions, pilot instructions, and product care guidance provided by Zen Cube.
14. Safety and Sensory Features
Zen Cube may include sensory features such as light, sound, projection, and optional aromatherapy. These features are intended to support calm and mindfulness, but individual responses may vary.
Aromatherapy should be used only as directed. Users should only use materials recommended by Zen Cube for aromatherapy. Essential oils or aroma materials should not be ingested, applied to skin unless expressly directed by the product instructions, or used around children, pets, pregnant individuals, or people with allergies, asthma, migraines, respiratory sensitivity, or scent sensitivity without appropriate caution and professional guidance when needed.
Lighting and projection features may not be appropriate for all users, including users with photosensitivity, seizure history, migraines, visual sensitivity, or other sensitivity to light patterns. Stop using the feature and seek appropriate help if discomfort occurs.
Keep the device dry and use only approved charging equipment and compatible power sources and accessories. Do not puncture, crush, expose to excessive heat, or attempt to disassemble the battery. Do not block ventilation openings or operate the device under bedding, cushions, or other materials that may trap heat. Do not modify the device, and do not use the device if it appears damaged, overheated, wet, unsafe, or otherwise not functioning properly. Dispose of electronic components and batteries according to local regulations.
15. Prohibited Uses
You agree not to use Zen Cube to harm, threaten, harass, exploit, or mislead any person; to violate any law or third-party right; or to interfere with the safety, security, or operation of the product.
You agree not to reverse engineer, decompile, copy, modify, scrape, interfere with, bypass security features of, or gain unauthorized access to Zen Cube, the application, the device, software, firmware, content, or related systems.
You agree not to use Zen Cube as a substitute for emergency services, medical care, mental health care, required supervision, school safety procedures, or professional judgment.
16. Feedback and Pilot Participation
During the pilot, you may provide feedback, comments, suggestions, survey responses, photos, videos, or other input about Zen Cube. Unless otherwise agreed in writing, you grant Zen Cube a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, create derivative works from, publish, display, and otherwise use your feedback for product development, research, improvement, marketing, fundraising, investor communications, and business purposes.
Please do not provide feedback that includes sensitive personal information about yourself, a child, student, family member, employee, client, patient, or any other person. If photos, videos, testimonials, or quotes may identify a person, Zen Cube may request separate written permission before using them publicly.
17. Intellectual Property
Zen Cube, the Zen Cube name, Zen Cube logo, Sanctuary Experience, product design, software, firmware, calming plans, meditation scripts, audio content, visual content, interface designs, documentation, and all related intellectual property are owned by Zen Cube or its licensors.
Subject to these Terms, Zen Cube grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the pilot product solely for approved pilot, personal, family, school, or internal wellness purposes. No ownership rights are transferred to you.
You may not copy, reproduce, distribute, sell, rent, sublicense, modify, reverse engineer, or create derivative works based on Zen Cube or any part of the product except as expressly permitted in writing by Zen Cube.
Any Zen Cube trademarks referenced in the product or materials may include applied-for trademarks. No right or license to use any Zen Cube trademark, trade name, or logo is granted without prior written permission.
18. Updates and Product Changes
Zen Cube may provide software, firmware, application, content, security, diagnostic, or other updates during the pilot. Some updates may be required for continued use of the product.
Zen Cube may add, remove, suspend, modify, or replace features, content, sensory options, third-party services, device behavior, or application functionality at any time, especially during the pilot period.
Because Zen Cube is in pilot testing, some features may not function as expected. You agree that Zen Cube may collect operational feedback and diagnostic information as described in these Terms and the Privacy Policy to improve product performance and reliability.
19. Availability and Connectivity
Certain Zen Cube features require Bluetooth, Wi-Fi, device power, mobile application access, third-party service availability, or compatible hardware and software. Zen Cube is not responsible for interruptions, delays, failures, or limitations caused by internet service providers, mobile operating systems, app store platforms, Bluetooth limitations, Wi-Fi networks, third-party services, user devices, or circumstances beyond Zen Cube’s reasonable control.
In family pilot testing, voice interaction and Artificial Intelligence (AI) features may require Wi-Fi connectivity between the Cube and the selected cloud voice provider. These features are not enabled for school pilot settings. If connectivity is unavailable or unstable, some family pilot voice features may not work or may be limited.
20. Privacy
Your use of Zen Cube is also subject to the Zen Cube Privacy Policy. The Privacy Policy explains how Zen Cube handles information in connection with the product and pilot.
These Terms summarize certain pilot data practices for convenience, but the Privacy Policy is intended to provide more detailed information. If there is a conflict between these Terms and the Privacy Policy regarding privacy practices, the Privacy Policy will control to the extent of that conflict.
21. No Warranties
Zen Cube is provided on an "as is" and "as available" basis, especially during the pilot. To the fullest extent permitted by law, Zen Cube disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, uninterrupted operation, and error-free operation.
Zen Cube does not warrant that the product will meet your needs, produce any particular result, improve any particular condition, prevent distress, be available at all times, operate without errors, or be suitable for every user or setting.
22. Limitation of Liability
To the fullest extent permitted by law, Zen Cube and its officers, directors, employees, contractors, advisors, agents, service providers, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, loss of goodwill, device malfunction, service interruption, emotional distress, personal decision-making, or reliance on any product output, even if Zen Cube has been advised of the possibility of such damages.
To the fullest extent permitted by law, Zen Cube’s total liability for any claim arising out of or relating to these Terms, the pilot, the device, the application, the Sanctuary Experience, or related services will not exceed the greater of the amount you paid directly to Zen Cube for the product or service giving rise to the claim or one hundred United States dollars (US $100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In that case, Zen Cube’s liability will be limited to the maximum extent permitted by law.
23. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Zen Cube and its officers, directors, employees, contractors, advisors, agents, service providers, licensors, and affiliates from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of Zen Cube, your violation of these Terms, your violation of any law or third-party right, your submission of sensitive personal information, or your use of Zen Cube with children, students, families, employees, clients, or other individuals without required permission or supervision.
24. Suspension or Termination
Zen Cube may suspend or terminate your access to the pilot, device features, application features, or related services if Zen Cube believes that you have violated these Terms, created a safety concern, misused the product, failed to follow pilot instructions, or used Zen Cube in a way that may create legal, security, privacy, operational, or reputational risk.
You may stop using Zen Cube at any time. Certain provisions of these Terms, including provisions relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution, will survive termination.
25. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, unless applicable law requires otherwise.
Subject to any mandatory rights you may have under applicable law, you agree that any dispute arising out of or relating to these Terms, Zen Cube, the pilot, the device, the application, or related services will be brought in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction and venue of those courts.
26. Changes to These Terms
Zen Cube may update these Terms from time to time, including as the product evolves from pilot testing to later versions. The updated Terms will be posted or provided with a new "Last Updated" date.
Your continued use of Zen Cube after updated Terms are posted or provided means that you accept the updated Terms, to the extent permitted by law.
